Agencies Release Fifth Set of FAQs on the Affordable Care Act

The Departments of Labor (DOL), Treasury, and Health and Human Services (HHS) (the agencies) jointly released on December 23, 2010 a fifth set of frequently asked questions (FAQs) concerning implementation of the Patient Protection and Affordable Care Act (Affordable Care Act) (P.L. 111-148), as well as FAQs regarding implementation of the Paul Wellstone and Pete Domenici Mental Health Parity and Addiction Equity Act of 2008.

Below is a list of topics addressed in the new FAQs.

  • Value-Based Insurance Design in Connection with Preventive Care Benefits
  • Automatic Enrollment in Health Plans
  • Disclosure Under PHS Act Section 2715(d)(4) (60-Day prior notice for material modifications to plans)
  • Dependent Coverage of Children to Age 26
  • Preexisting Condition Exclusions for Children in the Individual Market
  • Grandfathered Health Plans (cost-sharing requirements based on a percentage-of-compensation formula)
  • Mental Health Parity and Addiction Equity Act of 2008
  • Nondiscrimination Based on a Health Factor and Wellness Programs
