Agencies Issue Additional Details on Preventive Care Requirements for Women

On August 1, 2011, the Department of Health and Human Services (HHS) provided important details on the preventive care requirements that apply to women who participate in a group health plan. In conjunction with these guidelines, HHS, the Department of Labor (DOL), and Treasury (the agencies) amended the July 14, 2010 (published in the Federal Register on July 19, 2010) interim final regulations regarding coverage of preventive health services under the Patient Protection and Affordable Care Act (P.L. 111 148) (Affordable Care Act) to provide some flexibility to religious organizations whose beliefs may conflict with the recently issued guidance.

The new preventive care requirements that apply to women are effective for plan years starting on or after August 1, 2012. Therefore, for a calendar year group health plan, the additional updates will apply as of January 1, 2013.
