Proposed Regulation Intended to Allow Expanded Access to Fertility Benefits
The U.S. Departments of Labor, Health and Human Services, and Treasury announced a proposed regulation that would create a new category of limited excepted benefits that would allow (but not require) employers to expand the ability to offer fertility benefits to their employees. Similar to limited dental and vision coverage, the proposed regulation would exempt employer-sponsored fertility benefits from Affordable Care Act requirements and certain other federal health care coverage laws (including HIPAA and the No Surprises Act). If the proposed regulation is finalized, then employer plan sponsors will need to determine if they want to offer fertility coverage through their group health plan or as a limited excepted benefit or not at all.
