Supreme Court Schedules Oral Arguments in ACA Insurer Cases for December 10
On September 13, 2019, the U.S. Supreme Court announced it will hear oral arguments from health insurers in three combined cases (Maine Community Health Options v. United States, Land of Lincoln Mutual Health Insurance v. United States, and Moda Health Plan v. United States) in which the insurers contend they are owed millions of dollars in Affordable Care Act (ACA) payments from the federal government. The oral arguments are scheduled for December 10, 2019.

EEOC Announces It Will Not Renew Component 2 Pay Data Collection as Part of EEO-1 Report
On September 12, 2019, the Equal Employment Opportunity Commission (EEOC) announced its intent to seek authorization from the Office of Management and Budget (OMB) for a three-year approval to collect the EEO-1, Component 1, which the EEOC has been collecting since 1966. However, because the EEOC's 2016 request for OMB authorization included, for the first time, a request for approval for collection of pay data (Component 2), the Notice states that the Commission is not renewing its request for authorization to collect Component 2. In the Notice, the EEOC states that “The Commission now concludes that it should consider information from the ongoing Component 2 data collection before deciding whether to submit a pay data collection to OMB…At this point in time, the unproven utility to its enforcement program of the pay data as defined in the 2016 Component 2 is far outweighed by the burden imposed on employers that must comply with the reporting obligation.” Comments on the Notice are due no later than November 12, 2019.
